What is a Will?

It is a legal document that deals with your affairs when you die.  In your Will, you get to decide:-

  • Who receives your assets – your Beneficiaries
  • Who carries out your wishes – your Executors

What should you consider when making a Will?— Beneficiaries

You may consider the following:

  • Dividing your estate between family, friends and/or charities
  • Setting conditions for your beneficiaries to meet. Typically attaining a particular age e.g. 18, 21 or 25 years
  • Making small cash gifts
  • Gifts of specific items – e.g. jewellery

– Executors

An executor’s role includes:

  • Ensuring your Inheritance Tax bill is paid
  • Arranging valuations of your assets
  • Obtaining Probate
  • Paying your debts and funeral bill
  • Distributing your estate to your beneficiaries

You can appoint anyone over the age of 18 years to be your Executor.  At Donnelly & Elliott we can take the burden of acting as your executors.  We have the knowledge, experience and expertise to deal with your affairs.

 – Guardians

You can appoint a person(s) to take care of your infant children

 -Funeral Directions

You can leave instructions setting out

whether you wish to be buried or cremated

– Disinheriting beneficiaries

You can limit the risk of unwanted relatives trying to lay claim to your assets

When should you make a Will?

As soon as possible.  It is particularly relevant if:

  • You have young children
  • You have disabled children
  • You are about to get married/enter into a Civil Partnership
  • You live with someone
  • You are about to divorce
  • You run a business
  • You have foreign property/assets

To make or amend a Will you must be of sound mind.  Don’t leave it until it is too late!
